Public Forum

8 members of the public present.


A resident wished the traffic on Smithy Lane to be noted; the speed of vehicles was becoming a lot faster and more concerning, she went on to give an example of a van the previous Sunday travelling on the wrong side of the road. She thought dogwalkers avoided the lane as it was dangerous. She requested the SLOW was reinstated on the lane.

One resident went on to query that there were large boulders (not placed by himself) on the verge outside his house and if a car hit them who would be responsible.

There was a tree stump that could be hit by a car and the ownership was queried.

A resident queried the leaking drain under the road on Smithy Lane as it never seemed to be resolved and was always running water.

There was a concern from a landowner in the Parish that the septic tank from St Michael’s Cottages was leaking near The Old Vicarage and needed attention as it was seeping onto his land. Although this had happened for many years it had never been resolved.

The Chairman acknowledged all concerns and he would endeavour they would be on the agenda for the next meeting.


The Chairman welcomed the applicants for the Parish Councillor vacancy and asked each to give a summary as to the reasons of wishing to become a Councillor.

42/18 Minutes

Resolved that the minutes of the meeting held on 3rd May 2018 be approved and signed as a true and accurate record.


43/18 Acceptance of Office for Vice Chairman

Cllr G Booth signed the Acceptance of Office.


44/18 Co-option of Parish Councillor

The Parish Council had received three applications for the Councillor vacancy.

Mr M Wharton, Mr A Scott and Mr T Richardson were considered by members.

Resolved Mr M Wharton unfortunately could not be considered as there were no supporters from the electoral role.

Cllr GS proposed Mr A Scott and Cllr G Booth seconded.

Cllr P Amies proposed Mr T Richardson and Cllr M Wakerly seconded.

A vote was taken by members and the Clerk collated the results.

Resolved Mr T Richardson would be co-opted as a Parish Councillor.

The Acceptance of Office was signed, and the Register of Interest accepted for completion within 28 days.


45/18 Highways

VTC Consultants – The meeting was scheduled for 21st June at 7pm. Cllr G Booth wished some actions to be taken soon as the residents kept attending the meetings for support and she felt the Parish Council needed to take some quick fixes.

Ownership of verges along Smithy Lane and Mill Lane

There had been no reply to the enquiry made by the Clerk. It had been acknowledged Mr Andrew Kelly was caught with other Council business, but it would be actioned in priority order.

Resolved Cllr J Wray would request a completion date.

It was agreed the Clerk would contact the local PCSO to ask if the Parish Council could have access to a hand-held Speed Display gun and then subsequently train the Parish Councillors to utilise in the Parish.

BT Chamber on Mill Lane.

The Clerk had contacted BT and they had visited site and requested traffic management from Cheshire East to resolve the issue.

Weight Limit Signs on Radnor Bridge

The house building had now begun on Back Lane in conjunction with David Wilson Homes on Blackfirs Lane and when lorries were moving goods to and from the site they were travelling over Radnor bridge which had a 10.5 tonne weight limit.

It was agreed the Clerk would write to ‘Wigan Tippers’ to dissuade utilising the route over the bridge.

It was agreed the weight signs would be queried if they could be replaced.

Comments from a resident in relation to the number of accidents near/over Clonter Bridge.

This would be discussed at the highways meeting on 21st June but it was in the Parish of Lower Withington.

Somerford Booths boundary signs

Deferred to the next meeting.

46/18 Community Home Bonus Scheme

When setting the Budget on 22nd February 2018 CE Full Council agreed the establishment of a ‘New Homes Bonus – Community Fund’ to be set up at a value of £2m to cover the period 2018/19 and 2019/20 subject to development of an appropriate governance framework.

This report sets out the scheme that will be implemented during 2018/19. To ensure consistency with other schemes, any grants awards provided from the ‘New Homes Bonus – Community Fund’ will be based on the Corporate Grants protocol which is due to be considered for approval by Cabinet in July 2018.


47/18 Audit 2017/18

The Chairman ensured the certificate of exemption part 2 section 3 was completed and included, gross annual income in 2017/18 and gross annual expenditure in 2017/18 being less than £25,000.

Resolved full Council approved the certificate of income and expenditure less than £25,000

48/18 The Annual Governance Statement – Section 1

Resolved the Annual Governance Statement 2017/18 was accepted by full Council.


49/18 The Annual Governance Statement – Section 2

Resolved the Annual Governance Statement 2017/18 was accepted by full Council.


50/18 Financial Regulations

Resolved the would be accepted by Full Council.


51/18 Cheshire East

Resolved to suspend standing orders to receive a report from Ward Cllr Wray.

There was update on the Community Home Bonus scheme which was be finalised in June.

The approval of the construction company to build the Congleton Link Road would be approved at the cabinet meeting in June. The new Cheshire East Council highways contract would also be approved at this meeting.

Cllr JW would also get clarity from Mr A Kelly about the verge ownership in Smithy Lane/ Mill Lane.


52/18 Planning Applications

Cllr G Silman left the meeting.

  • 18/2712C Land off Smithy Lane, Hulme Walfield – resubmission of application17/5831C: construction of eventing training and livery facility.

It was agreed to defer this application until the next meeting.

Cllr G Silman returned to the meeting.

  • 18/2740C 19 Lomas Way, Congleton Cw12 2GH- a construction of a detached garage.

Resolved No comment


Alderley Gate – No issues currently.

54/18 Clerks Report


The Clerk gave the Council on progress to date.

The Privacy statement had been drafted and would go on the website and then a notice would be sent to the email recipients to opt in to the website.

Police Cluster meeting 9th July 2018 in Holmes Chapel Community Centre

Cllr M Wakerly would attend.


The next meeting would be the on 5th July 2018 @ 7.30pm at ‘Westlow Mere’ fisheries.
